End User License Agreement

This End User License Agreement ("Agreement") governs your use of the Superhome software distributed as a Docker image / Home Assistant app and the associated licensing and update services (the "Software"). By activating, installing, or using the Software (including by entering or activating a Superhome license key) you agree to this Agreement, the Terms of Service and the Privacy Policy.
1. License grant
Subject to your compliance with this Agreement and to an active Superhome subscription/license, you are granted a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to run one instance of the Software, bound to a single Home Assistant installation, on hardware you own or control, plus the additional worker containers permitted by your tier (max_devices), solely for your own personal or internal home-automation use.
2. Restrictions
- do not copy, redistribute, sublicense, sell, rent, lease, or host the Software or the model bundles for any third party;
- do not reverse engineer, decompile, disassemble, or attempt to derive the source code, model weights, or trade secrets, except to the limited extent applicable law prohibits this restriction;
- do not remove, disable, bypass, or circumvent any activation, heartbeat, encryption, or other technical protection measure, or use the Software without a valid, active license;
- do not extract, decrypt, copy, re-train from, or incorporate the model weights into any other product or service;
- do not use the Software to build or operate a competing product or service, or in a multi-tenant / "as-a-service" arrangement, without our written authorisation.
3. Subscription, activation and connectivity
The Software requires online activation and periodic heartbeat validation to obtain and retain the decrypted models. A license is bound to one Home Assistant instance on first activation; moving to a new instance requires re-association (rebind). You are responsible for the security of your account and license key.
4. Ownership
The Software is licensed, not sold. Superhome and its licensors retain all right, title, and interest in the Software, the model weights, and all intellectual property therein. "Superhome", the name and the logo are trademarks of Superhome. Certain installer/integration files are made available separately under the MIT License; this Agreement does not limit your rights in those files.
5. Term and termination
This Agreement is effective until terminated. It terminates automatically when your subscription/license expires or is revoked, or upon any breach. On termination, model access is withdrawn (activation/heartbeat will fail and the Software enters a degraded mode) and you must cease using the Software.
6. Disclaimer of warranty
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND. Superhome does not warrant that the Software will be uninterrupted, error-free, or suitable for any safety-critical use.
7. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUPERHOME SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. Nothing excludes liability or mandatory consumer-protection rights that cannot be excluded under applicable law.
8. Governing law
This Agreement is governed by the laws of the European Union and of Italy, without prejudice to any mandatory consumer-protection rights in your country of residence.
